Client-owned data, branding and materials remain the property of the client or their licensors.

- reviewing deliverables, recommendations or reports within a reasonable timeframe;
- making business decisions based on their own assessment of risk, legal obligations and commercial priorities; and
- maintaining appropriate permissions, licences and contractual rights in relation to third-party platforms and data provided to KNOP.
KNOP is not responsible for delays, issues or limitations caused by incomplete information, delayed approvals, restricted access, third-party platform limitations or circumstances outside our reasonable control.
12. Confidentiality of Client Information
KNOP will treat non-public client information provided in connection with a project as confidential and will use it only for the purpose of providing the agreed services, unless disclosure is required by law or authorised by the client.
This clause does not apply to information that is publicly available, already lawfully known to KNOP, independently developed by KNOP without reference to the client’s information, or lawfully received from another source.
13. Limitation of Liability
To the maximum extent permitted by law, KNOP excludes all liability for any loss, damage, cost or expense arising from or in connection with:
- your use of, or reliance on, this website or its content;
- interruptions, errors or unavailability of the website;
- the acts, omissions or failures of third-party platforms or providers;
- inaccuracies in data supplied by clients or third parties; or
- decisions made by you or your business based on website content, reports, recommendations or data analysis.
To the maximum extent permitted by law, KNOP will not be liable for any indirect, consequential, incidental or special loss, including loss of revenue, profit, business opportunity, data, goodwill or anticipated savings.
Where liability cannot be excluded, KNOP’s total liability in connection with this website or any related services will be limited to the amount paid by the client to KNOP for the relevant services giving rise to the claim, or if no services have been paid for, NZD $100.
Nothing in these Terms excludes or limits any rights or remedies that cannot lawfully be excluded under New Zealand law.
